The purpose of these General Terms and Conditions of Sale is to define the contractual relationship between AGILITYO and the CLIENT, applicable to all purchases made on the agilityo.com website. The CLIENT is defined as any individual of legal age or non-commercial legal entity. The acquisition of a PRODUCT via the agilityo.com website implies unreserved acceptance of the present General Terms and Conditions of Sale by the CLIENT, who acknowledges having perfect knowledge thereof at the time of any order placement and/or subscription. The present terms and conditions shall prevail over any other general or special terms and conditions not expressly approved by AGILITYO. The CLIENT recognizes being informed that the present Terms and Conditions of Sale do not require a handwritten signature to be accepted and engage their responsibility once they have created and validated their online order. The General Terms and Conditions of Sale applicable shall be those in force on the day the order is validated. AGILITYO reserves the right to modify these General Terms and Conditions of Sale at any time and without prior notice.

AGILITYO offers a range of products via the agilityo.com website. These products may include training programs, personalized coaching sessions, and digital content accessible directly from the CLIENT's personalized account. The products offered are subject to availability.

Article 3 – Pricing

The prices listed on the agilityo.com website are in euros and include all taxes (TTC), taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. AGILITYO reserves the right to modify its prices at any time, it being understood that the price listed on the website on the day of the order shall be the only one applicable to the CLIENT.

 

Article 4 – Orders

To place an order, the CLIENT must:

• Fill out the identification form with their complete contact information or provide their customer number if they have one.

• Select the desired products.

• Confirm the order after checking it.

• Make the payment under the specified conditions.

• Confirm the order and payment.

Order confirmation implies acceptance of these General Terms and Conditions of Sale, acknowledgment of having perfect knowledge of them, and waiver of the right to invoke one's own terms and conditions of purchase or other conditions. All the provided data and the recorded confirmation will serve as proof of the transaction. Order confirmation will be worth signing and accepting the operations carried out. AGILITYO will communicate by email confirmation of the registered order.

 

Article 5 – Payment

The fact of validating your order implies for you the obligation to pay the indicated price. Payment for your purchases is made by credit card via a secure system. The card is only charged when the order is shipped. In the event of non-availability of certain items ordered, only the amount of the available products will be debited.

 

Article 6 – Right of Withdrawal

Under Article L121-20 of the Consumer Code, the CLIENT has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty, except for the return costs.

 

Article 7 – Liability

AGILITYO, in the process of selling online, is bound only by an obligation of means; it cannot be held liable for damage resulting from the use of the Internet network such as data loss, intrusion, virus, service interruption, or other involuntary problems.

 

Article 8 – Intellectual Property

All elements of the agilityo.com website are and remain the intellectual and exclusive property of AGILITYO. No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, elements of the site, whether they are software, visual, or sound. Any simple or hypertext link is strictly prohibited without the express written consent of AGILITYO.

The information requested from the CLIENT is necessary for the processing of their order and may be communicated to the contractual partners of AGILITYO involved in the execution of this order. The CLIENT may write to AGILITYO to exercise their rights of access, rectification, and opposition concerning the information provided as part of their order.

 

Article 10 – Governing Law and Jurisdiction

These General Terms and Conditions of Sale are governed by French law. In the event of a dispute, jurisdiction is assigned to the competent courts of Aubenas, notwithstanding multiple defendants or warranty claims.

By validating an order on the agilityo.com website, the CLIENT accepts these General Terms and Conditions of Sale fully and without reservation.
